These Terms of Service ("Terms") govern your use of this website and application funnel, and your engagement with the coaching services offered by NLP Fitness Inc, operating as Alan Dyck Fitness ("we", "us", "our"). By using this site, submitting an application, booking a call, or purchasing a program, you agree to these Terms. If you do not agree, do not use the site or our services.
1. Who We Are
NLP Fitness Inc is a coaching business based in Kelowna, British Columbia, Canada. We provide fitness, nutrition, and mindset coaching programs delivered online and by phone or video call.
2. Eligibility
You must be at least 18 years old to use this site, submit an application, or purchase our services. By using the site you confirm that you are 18 or older and legally able to enter into a binding agreement.
3. Applications and Calls
Submitting an application or booking a call does not guarantee acceptance into a program. We review each application and reserve the right to accept or decline any applicant at our discretion. Information you provide must be accurate and complete.
4. Payments and Refunds
Program pricing, payment schedules, and refund terms are presented at the time of purchase in your enrollment agreement or checkout. Those purchase terms govern your specific program. Unless your enrollment agreement states otherwise, fees are due as invoiced and payments are processed by third-party payment providers subject to their own terms.
5. Not Medical Advice
Our programs are coaching and education, not medical care. Nothing on this site or in our programs is medical advice, diagnosis, or treatment. Read our Health Disclaimer before starting any training or nutrition program, and consult your physician first.
6. Results Vary
Results from coaching depend on your effort, consistency, starting point, and circumstances. Testimonials and case studies on this site reflect real client outcomes, but they are not promises of what you will achieve. We make no guarantee of specific fitness, health, or body composition results.
7. Intellectual Property
All content on this site and in our programs, including text, videos, workbooks, training plans, branding, and course materials, is owned by NLP Fitness Inc or licensed to us. You receive a personal, non-transferable license to use program materials for your own training. You may not copy, resell, redistribute, or share our materials without written permission.
8. Acceptable Use
You agree not to:
- Use the site or our materials for any unlawful purpose
- Attempt to interfere with, disrupt, or gain unauthorized access to the site or its systems
- Submit false information in an application or impersonate another person
- Scrape, harvest, or collect data from the site by automated means
- Share private program content, calls, or community discussions outside the program
9. Third-Party Services
Our funnel uses third-party tools for scheduling, payments, and communications. We are not responsible for the content or practices of third-party sites or services linked from our pages. Your use of them is at your own risk and subject to their terms.
10. Limitation of Liability
To the maximum extent permitted by law, NLP Fitness Inc, its directors, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our services, including lost profits, lost data, or personal injury connected to your voluntary participation in physical training. Our total liability for any claim relating to the services will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnity
You agree to indemnify and hold NLP Fitness Inc harmless from claims, damages, and expenses arising out of your breach of these Terms or your misuse of the site or our materials.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, without regard to conflict of law rules. You agree that the courts of British Columbia have exclusive jurisdiction over any dispute relating to these Terms or our services.
13. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page shows the current version. Continued use of the site or our services after changes are posted means you accept the updated Terms.
